These Terms of Service (the “Terms”) govern access to and use of the Eastern Outdoors LLC website at eastern-outdoors.com and any purchase of products from Eastern Outdoors LLC (“Eastern Outdoors,” “we,” “us,” or “our”). By accessing the website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the website or place an order.

1. Eligibility and Legal Compliance

By using the website or placing an order, you represent, warrant, and agree that:

• you are legally permitted to purchase, possess, receive, own, and use the products you order;
• you meet all minimum age requirements applicable to the products ordered and the destination jurisdiction;
• you are not prohibited by any federal, state, or local law, regulation, court order, or other legal restriction from purchasing, possessing, receiving, or using the products ordered;
• all information you provide to Eastern Outdoors is true, complete, current, and accurate; and
• you will not use any product for any unlawful purpose.

Eastern Outdoors may refuse service, cancel orders, delay shipment, request additional information, or deny access to the website if we believe a transaction may violate law, carrier rules, payment rules, safety requirements, the posted Shipping Restrictions Policy, or these Terms.

1. Restricted Products and Restricted Jurisdictions

All sales are subject to federal law, Pennsylvania law, carrier rules, the posted Shipping Restrictions Policy, and the laws and regulations of the destination jurisdiction. Eastern Outdoors does not guarantee that any product is lawful for purchase, possession, receipt, or use in every location. If there is any conflict between a product listing and the posted Shipping Restrictions Policy or Eastern Outdoors’ compliance review, the posted Shipping Restrictions Policy and compliance determination will control.

Eastern Outdoors may restrict, refuse, cancel, or modify any order based on:

• the destination state, county, city, or locality;
• the type of ammunition, magazine, component, accessory, or related product ordered;
• the purchaser’s age, identity, eligibility, or documentation;
• carrier limitations; or
• any compliance, fraud, safety, or operational concern.

Eastern Outdoors may review products and orders on a SKU-by-SKU, order-by-order, and destination-by-destination basis. Certain products, including but not limited to steel-tip, steel-core, armor-piercing, tracer, incendiary, explosive, or similar items, may be unavailable for sale or shipment in some jurisdictions or to some purchasers. Eastern Outdoors reserves the right to determine, in its sole discretion, whether any product will be offered, sold, shipped, or cancelled, including after payment but before shipment if later compliance review identifies a restriction or concern.

1. Customer Responsibility for Destination-Law Compliance

You are solely responsible for knowing and complying with the laws applicable to the shipping destination and to your purchase, receipt, possession, storage, and use of any product ordered. Placement of an order does not mean the order has been accepted or that shipment is lawful.

If Eastern Outdoors cancels an order because of a legal restriction, suspected legal restriction, inability to verify eligibility, or a later compliance determination made before shipment, Eastern Outdoors may issue a refund in the amount actually collected, less any nonrefundable payment-processing, chargeback, or similar costs to the extent permitted by law.

1. Age, Identity, and Eligibility Verification

Eastern Outdoors may require age verification, identity verification, address verification, documentation review, database screening, fraud screening, or other review before accepting, processing, or shipping any order. You authorize Eastern Outdoors to request and review information reasonably necessary to verify your identity, age, billing information, shipping information, and legal eligibility, and to use third-party age-verification, identity-verification, address-verification, fraud-screening, or similar service providers for that purpose.

If verification cannot be completed to Eastern Outdoors’ satisfaction, if you do not timely provide requested information or documentation, or if later compliance review identifies a legal, carrier, payment, fraud, safety, or operational concern, Eastern Outdoors may refuse, cancel, or hold the order without liability, including after payment has been submitted but before shipment.

1. Order Acceptance; Pricing; Availability

All product listings, prices, specifications, and availability are subject to change without notice. Product descriptions, photographs, packaging, lot numbers, and manufacturer specifications may vary. Product listings and payment confirmation do not guarantee that any item is lawful, available, or approved for shipment to a particular purchaser or destination.

Your submission of an order is an offer to purchase. No order is accepted until Eastern Outdoors elects to accept it. Eastern Outdoors may decline or cancel any order at any time before shipment, including for pricing error, inventory error, suspected fraud, suspected illegality, carrier limitation, verification failure, or later compliance review under the posted Shipping Restrictions Policy or these Terms.

If a pricing, listing, or inventory error occurs, Eastern Outdoors may cancel the order and refund the amount charged.

1. No Remanufactured Ammunition

Unless a product is expressly identified otherwise in writing, Eastern Outdoors represents only that its ammunition offerings are sold as new ammunition. Eastern Outdoors does not sell remanufactured ammunition.

1. Payment; Taxes

You agree to pay all amounts due for your order, including product price, shipping, handling, taxes, fees, and any other disclosed charges. You authorize Eastern Outdoors to charge your selected payment method for the full amount due.

You are responsible for any applicable sales, use, excise, or similar taxes unless a valid exemption is accepted by Eastern Outdoors in writing before shipment.

1. Shipping Policy

Ammunition will ship only by shipping methods approved by Eastern Outdoors and permitted by applicable law and carrier policy. Eastern Outdoors may limit shipping methods, package contents, package weights, destinations, delivery locations, and delivery timing.

Eastern Outdoors will not ship to any address, location, or jurisdiction that Eastern Outdoors determines to be prohibited, restricted, unverifiable, unsafe, or noncompliant. We may require shipment to a physical street address and may refuse shipment to P.O. boxes, freight forwarders, reshippers, or other locations Eastern Outdoors deems inappropriate.

Delivery dates are estimates only and are not guaranteed.

1. Risk of Loss; Shipping Damage; Claims

To the fullest extent permitted by law, title to and risk of loss for products pass to the purchaser when Eastern Outdoors tenders the shipment to the carrier.

Eastern Outdoors is not responsible for carrier-caused loss, theft, delay, mishandling, or shipping damage after tender to the carrier. After tender, any transit-related claim rests with the carrier, subject to any claim rights Eastern Outdoors chooses to pursue or assist with in its discretion. You must inspect the package promptly upon delivery. Any visible shipping damage, shortage, or delivery irregularity should be noted with the carrier and reported to Eastern Outdoors promptly at EasternOutdoorsAmmo@gmail.com. To the fullest extent permitted by law, your remedy for carrier-caused loss, theft, delay, mishandling, or shipping damage is limited to available carrier-claim rights and any carrier-claim assistance Eastern Outdoors elects, but is not obligated, to provide.

1. No Returns or Exchanges

All ammunition sales are final. Eastern Outdoors does not accept returns or exchanges of ammunition.

Except as required by nonwaivable law, Eastern Outdoors is under no obligation to accept returns or exchanges of any product. Any exception must be expressly authorized by Eastern Outdoors in writing in advance. Unauthorized returns may be refused, destroyed, or returned to sender at your expense.

1. Manufacturer Warranties; Optics

Any warranty on optics or similar manufacturer-warranted products is provided, if at all, by the product manufacturer and not by Eastern Outdoors, unless Eastern Outdoors expressly states otherwise in a separate written document signed by Eastern Outdoors.

Warranty claims for optics should be submitted directly to the manufacturer in accordance with the manufacturer’s warranty process. Eastern Outdoors may provide manufacturer contact information as a courtesy but is not responsible for administering, honoring, or extending any manufacturer warranty.

Eastern Outdoors does not provide any independent warranty for ammunition, accessories, optics, or manufacturer specifications unless expressly stated in a separate written agreement signed by Eastern Outdoors.

1. Disclaimer of Warranties

Except to the extent prohibited by applicable law or expressly stated in a separate written agreement signed by Eastern Outdoors, the website and all products are provided “as is” and “as available,” with all faults.

Eastern Outdoors disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. Eastern Outdoors does not warrant that the website will be uninterrupted, error-free, secure, or compatible with your device, or that any product will meet your subjective expectations. Product descriptions, photographs, packaging, lot numbers, and manufacturer specifications are provided for general informational purposes only and do not create any warranty by Eastern Outdoors.

1. Safe Use; Product Responsibility

You are solely responsible for ensuring that any product you purchase is used only:

• in a lawful manner;
• in a safe manner;
• by a qualified and legally permitted person; and
• in a firearm or platform for which the product is designed and appropriate.

You must follow all manufacturer instructions, warnings, and specifications. Eastern Outdoors is not responsible for misuse, improper storage, improper handling, unlawful transfer, incompatible use, modification, negligent use, or use by any third party.

1. Account Security and Prohibited Conduct

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity occurring through your account.

You may not:

• use the website for any unlawful, fraudulent, misleading, or abusive purpose;
• provide false age, identity, billing, shipping, or eligibility information;
• attempt to evade shipping restrictions or destination restrictions;
• use another person’s payment method or identity without authorization;
• interfere with website operation or security; or
• copy, scrape, reverse engineer, or exploit website content except as allowed by law.

Eastern Outdoors may suspend or terminate access to the website or an account at any time for suspected violation of these Terms.

1. Indemnification

You agree to defend, indemnify, and hold harmless Eastern Outdoors and its owners, officers, members, managers, employees, agents, successors, and assigns from and against any claim, demand, action, liability, loss, damage, judgment, fine, penalty, cost, or expense, including reasonable attorneys’ fees, arising out of or related to:

• your breach of these Terms;
• your unlawful purchase, attempted purchase, possession, receipt, transfer, storage, shipment, or use of any product;
• your misuse of the website or any product; or
• your violation of any law or the rights of any third party.

1. Limitation of Liability

To the fullest extent permitted by law, Eastern Outdoors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any lost profits, lost revenue, loss of use, loss of business, loss of opportunity, or diminution in value, arising out of or related to the website, any order, any shipment, any delay, or any product, even if Eastern Outdoors has been advised of the possibility of such damages.

To the fullest extent permitted by law, Eastern Outdoors’ total liability arising out of or related to any claim shall not exceed the amount actually paid by you to Eastern Outdoors for the specific product giving rise to the claim.

1. Website Content and Intellectual Property

All website content, including text, graphics, logos, photographs, product listings, and design, is owned by or licensed to Eastern Outdoors and is protected by applicable law. You may use the website only for lawful personal or internal business shopping purposes. No other use is permitted without Eastern Outdoors’ prior written consent.

1. Privacy

Eastern Outdoors respects customer privacy and uses customer information only for legitimate business, operational, compliance, and customer-service purposes. Information submitted through the website, including account information, order information, billing information, shipping information, verification information, and customer-service communications, may be used to process orders, verify age and identity, confirm legal eligibility, complete payment, arrange shipment, respond to customer inquiries, improve the shopping experience, prevent fraud, maintain website security, enforce Eastern Outdoors’ policies, and comply with applicable law.

Eastern Outdoors does not sell customer personal information. Eastern Outdoors will not disclose customer information to third parties except as reasonably necessary to process orders, complete payment, verify age or identity, ship products, provide customer service, operate the website, prevent fraud or misuse, enforce these Terms or other posted policies, protect the rights, property, or safety of Eastern Outdoors, its customers, or others, comply with applicable law, respond to lawful requests from governmental or law-enforcement authorities, or participate in a legal, regulatory, or administrative proceeding.

Eastern Outdoors may share customer information with trusted service providers who assist with website hosting, payment processing, order fulfillment, shipping, age and identity verification, fraud prevention, data security, customer communications, and similar business functions. Such service providers are authorized to use customer information only as necessary to provide services to Eastern Outdoors or as otherwise permitted by applicable law.

Eastern Outdoors implements reasonable administrative, technical, and physical safeguards designed to protect customer information submitted through the website and during the purchasing process. However, no website, payment system, transmission method, or electronic storage system can be guaranteed to be completely secure. Customers are responsible for maintaining the confidentiality of their account credentials and for promptly notifying Eastern Outdoors of any suspected unauthorized account activity.

Customer information submitted through the website is also subject to the Eastern Outdoors Privacy Policy, which is incorporated into these Terms by reference. If there is any conflict between this Section and the Privacy Policy, the Privacy Policy will control with respect to Eastern Outdoors’ collection, use, disclosure, retention, and protection of customer information.

1. Electronic Communications

You consent to receive communications from Eastern Outdoors electronically, including order confirmations, shipment notices, policy updates, verification requests, and customer-service communications. Electronic communications satisfy any legal requirement that a communication be in writing to the extent permitted by law.

1. Governing Law; Venue

These Terms and any dispute arising out of or relating to the website, any order, or any product shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles.

For the avoidance of doubt, the foregoing governing-law provision applies to contract and dispute issues only and does not authorize any purchase, sale, shipment, transfer, receipt, possession, or use of any product that is prohibited or restricted by federal law, carrier rules, the posted Shipping Restrictions Policy, or the law of the destination jurisdiction. Any nonwaivable restriction or requirement imposed by the destination jurisdiction remains controlling notwithstanding these Terms.

You agree that any dispute not otherwise resolved by the parties shall be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to personal jurisdiction and venue in those courts.

1. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

1. No Waiver

No waiver by Eastern Outdoors of any breach or default shall be deemed a waiver of any prior or subsequent breach or default.

1. Changes to Terms

Eastern Outdoors may revise these Terms at any time by posting an updated version to the website. The updated Terms will become effective on the posted effective date unless otherwise stated. Your continued use of the website or placement of an order after updated Terms are posted constitutes acceptance of the revised Terms.

1. Entire Agreement

These Terms, together with any posted Shipping Restrictions Policy, Privacy Policy, checkout certifications, and any other written policy expressly incorporated by reference, constitute the entire agreement between you and Eastern Outdoors regarding the website and the purchase of products through the website.

If there is any conflict between these Terms, any product listing, advertisement, checkout communication, or other website content, on the one hand, and the posted Shipping Restrictions Policy or Eastern Outdoors’ compliance determination, on the other hand, the posted Shipping Restrictions Policy and Eastern Outdoors’ compliance determination will control with respect to product availability, purchaser eligibility, shipment eligibility, destination restrictions, and order acceptance or cancellation.

By checking the box indicating acceptance of these Terms or by placing an order, you certify that:

• you have read and agree to these Terms and the posted Shipping Restrictions Policy;
• you are legally eligible to purchase and receive the products ordered;
• the shipping destination is lawful for the products ordered and you are responsible for complying with destination-law restrictions;
• all information you provided is accurate;
• you understand that orders remain subject to verification, compliance review, and the posted Shipping Restrictions Policy, and may be refused, held, modified, or cancelled, including after payment but before shipment, if Eastern Outdoors later identifies a legal restriction, suspected legal restriction, carrier limitation, verification failure, fraud concern, safety concern, or other operational concern; and
• you understand that ammunition sales are final and not returnable or exchangeable.
